Krasniqi: AMA’s independence is measured by indicators, not by perceptions. The courts have confirmed the legality of our decisions

The Audiovisual Media Authority Chairwoman, Armela Krasniqi, reported today to the Parliamentary Committee on Human Rights and Means of Public Information regarding the institution’s annual work report for the previous year. She emphasized that “during 2025, AMA’s Board adopted approximately 110 decisions, while over the past 5 years more than 550 decisions have been adopted, over 67% of which with unanimous agreement”.

In her remarks, Krasniqi said that “this demonstrates decision-making grounded in law, professionalism and institutional accountability. Among the totality of these decisions are 27 decisions on the determination of license/authorization invalidity, 48 decisions on license renewals, 76 decisions on authorization renewals, 6 decisions on license revocations, 7 decisions on authorization revocations, 2 decisions on the granting of licenses, 43 decisions on the granting of authorizations, 17 decisions on various bylaws; 9 decisions on the opening of competitions for available Audio/Audiovisual frequencies”.

 “The Audiovisual Media Authority has conducted monitoring of 7 electoral campaigns,” she added, “and has issued decisions imposing 38 fines for content violations and 44 fines for television piracy, amounting in total to over 80 million ALL”.

But how do these decisions stand when they are challenged against court rulings?

 “During the reporting year alone, AMA has won 15 court proceedings and has lost only one. Over the past 5 years, out of 49 proceedings concluded at first instance, 44 have been won by the Authority. This means that in approximately 82% of cases, Albanian courts have confirmed as correct and grounded in law AMA’s decisions”, stated Krasniqi.

Krasniqi stated that “the independence of a regulatory authority is not measured by political declarations, nor by perceptions, nor by claims. It’s measured by the decisions it takes, by its activity’s transparency and by its ability to defend those decisions under institutional and judicial control”.

According to her, this is not merely a statistical achievement, but evidence that whenever AMA has intervened against piracy, taken measures to protect broadcasting standards, or required compliance with the law in audiovisual content, it has acted on solid legal and professional grounds.

Ultimately, Krasniqi added, the independence of an institution is not proven by how often it declares itself independent, but by how often its decisions withstand the most rigorous test: the judgement of the law.

“Independence is not a privilege of institutions. Independence is an obligation to citizens. Independence is proven through the decisions it takes, the pressures it resists and the interests it refuses to submit to. Independence is earned every day. It’s earned when the law is placed above interest. When professionalism is placed above influence. When decision-making is guided by public responsibility rather than short-term calculations. And if there is a way to assess the independence of an institution, it’s not what the institution says about itself”, Krasniqi emphasized.

Krasniqi stated that “during 2025, the Council of Complaints handled 432 complaints, 365 of which were submitted by individual citizens. This means that every day of the year a citizen knocked on AMA’s door seeking protection of a violated right.”

Over 84% of these complaints were submitted by citizens. This is not merely a figure.

It’s a clear signal that the public regards this institution as a genuine protection mechanism and not as a remote bureaucratic institution.

Also, during 2025 were reviewed 329 programme cases. In 106 of them, legal and ethical standards violations were identified, for which the necessary measures were taken in accordance with legal provisions.

In total, during 2025, AMA issued 32 sanctioning decisions involving fines (for piracy, content violations, etc.) and 141 “Attention Drawn”.
